In her recent article in this journal, Joy Gordon provides an astute history and critique of the evolution and application of smart sanctions within the United Nations system since the mid-1990s. Her analysis of the strengths and weaknesses of the discrete types of smart sanctions is part of a growing discussion among both academics and practitioners about the future and the utility of these measures. As always, her continued skepticism about the effectiveness and ethical dimensions of economic sanctions deserves (...) serious consideration and evaluation. In particular, Gordon raises three central concerns: (1) smart sanctions are no more successful than traditional trade sanctions; (2) each type of targeted mechanism has serious flaws; and (3) targeted sanctions did not end the humanitarian damage or the related ethical dilemmas that are embedded into sanctions design and implementation. The transplant community has faced unprecedented challenges balancing risks of performing living donor transplants during the COVID-19 pandemic with harms of temporarily suspending these procedures. Decisions regarding postponement of living donation stem from its designation as an elective procedure, this despite that the Centers for Medicare and Medicaid Services categorise transplant procedures as tier 3b (high medical urgency—do not postpone). In times of severe resource constraints, health systems may be operating under crisis or contingency standards of care. In this manuscript, (...) the United Network for Organ Sharing Ethics Workgroup explores prioritisation of living donation where health systems operate under contingency standards of care and provide a framework with recommendations to the transplant community on how to approach living donation in these circumstances.To guide the transplant community in future decisions, this analysis suggests that: (1) living donor transplants represent an important option for individuals with end-stage liver and kidney disease and should not be suspended uniformly under contingency standards, (2) exposure risk to SARS-CoV-2 should be balanced with other risks, such as exposure risks at dialysis centres. Because many of these risks are not quantifiable, donors and recipients should be included in discussions on what constitutes acceptable risk, (3) transplant hospitals should strive to maintain a critical transplant workforce and avoid diverting expertise, which could negatively impact patient preparedness for transplant, (4) transplant hospitals should consider implementing protocols to ensure early detection of SARS-CoV-2 infections and discuss these measures with donors and recipients in a process of shared decision-making. The challenge of intercultural relations has become an important issue in many societies. In spite of the claimed value of intercultural diversity, successful outcomes as predicted by the contact hypothesis are but one possibility; on occasions intercultural contact leads to intolerance and hostility. Research has documented that one key mediator of contact is perspective taking. Differences in perspective are significant in shaping perceptions of contact and reactions to it. The ability to take the perspective of the other and to understand (...) it in its own terms is a necessary condition for successful intergroup outcomes. This paper sheds light on the processes involved in intercultural perspective taking by elaborating the notion of the point of view based on social representations theory. The point of view provides a theory of social positioning that can analyse cultural encounters between social actors, and identify the conditions for positive relations. Insights are drawn from a study of public views on the relative merits of science and religion, following a documentary by Richard Dawkins in which it was suggested that religion is a source of evil. The findings demonstrate that the point of view may be categorised according to a three-way taxonomy according to the extent to which it is open to another perspective. A point of view may be monological—closed to another's perspective entirely, dialogical—open to the possibility of another perspective while maintaining some percepts as unchallengeable, or metalogical—open to another's perspective based on the other's frame of reference. Organizational learning, at the broadest levels, as it has come to be understood within the organization theory and management literatures, concerns the experientially driven changes in knowledge processes, structures, and resources that enable organizations to perform skillfully in their task environments (Argote and Miron–Spektor, 2011). In this chapter, we examine routines and capabilities as an important micro–foundation for organizational learning. Adopting a micro–foundational approach in line with Barney and Felin (2013), we propose a new model for explaining how routines and (...) capabilities play a causal role in transforming experience into repertoires of (actual or potential) organization–level behavior. More specifically, we argue that routines and capabilities are built out of capacities for shared – both joint and collective – intentionality (Tomasello, 1999, 2014; Bratman, 1999a, 2014) that enable individuals to engage in complex forms of collaboration in conjunction with multiple layers of scaffolds that encompass material and symbolic resources, social processes, and cultural norms and practices (Weick, 1995; Hutchins, 1995; Clark, 1997, 2008; Orlikowski, 2007). In short, we outline what we call the ‘scaffolded joint action’ model and suggest its potential as a micro–foundation of organizational learning. (shrink)

The twenty‐six‐year‐old patient requested a prophylactic bilateral mastectomy with reconstruction because of an extensive family history of cancer. She reported that she had developed melanoma at twenty‐five; that her mother, sister, aunts, and a cousin all had breast cancer; that a cousin had ovarian cancer at nineteen; and that a brother was treated for esophageal cancer at fifteen. The treating team was skeptical about this history, and they could find no documentation of the patient's reported melanoma. The surgeon wrote the (...) patient's primary care physician, explaining that he had seen the patient and planned to proceed with the bilateral mastectomy and reconstruction. The primary care physician responded that he was unable to substantiate several of the patient's claims; some of his colleagues believed the family history to be fabricated. Trying to make sense of the discrepancies, the genetic counselor called a counselor colleague who had met with this patient. The colleague suggested that the in‐house genetic counselor “google” the patient. The search revealed two Facebook pages linked to the patient. In one, apparently a personal profile, the patient stated that in addition to battling stage four melanoma, she had recently been diagnosed with breast cancer. She provided a link to a site where she solicited donations to attend a summit for young cancer patients. The other Facebook page featured numerous pictures of her with a bald head, as though she has been through chemotherapy. The genetic counselor showed the Facebook pages to the surgeon, who then decided not to operate. Should health care professionals “google” their patients? (shrink)

This paper poses the question, “what are providers’ obligations to patients who lie?” This question is explored through the lens of a specific case: a 26–year–old woman who requests prophylactic bilateral mastectomy with reconstruction reports a significant and dramatic family history, but does not want to undergo genetic testing. Using a conversational–style discussion, the case is explored by a breast surgeon, genetic counselor/medical geneticist, clinical psychologist, chair of a hospital ethics committee and director of a clinical ethics consultation service.

Recent work in the theoretical humanities has given increasing importance to what has been termed posthumanism and hypertextuality. For many within the humanities, posthumanism and hypertextuality have become accessible as a result of studies which have interdisciplinarily explored concerns that have evident implications for the humanities interest in aesthetics, ethics, politics, mind, cognition, identity, subjectivity and language. The work of Donna Haraway, N. Katherine Hayles, Elaine Graham, George P. Landow and others has been at the forefront of these initiatives. (...) What perhaps needs to be looked at now is the extent to which the interdisciplinary work that has been built up in this new field (which has been called new cultural theory) is a developing episteme, and how it might affect future ways of writing and thinking in the humanities. The paper proposed attempts to explore how new cultural theory, and especially the digitalist strain in the theoretical humanities, might profitably explore ways of integrating certain key concepts and practices in posthumanism and hypertextuality. Familiarity with the literature of both discourses reveals that while the two have obvious affinities, these have not always been approached in ways which would allow the conceptuality of one field to productively merge with those of the other. What seems to be particularly pressing is some speculation on how thought itself is reshaped through interaction with the new modalities of writing and language, and through attunedness to the potentialities of new posthuman ways of being. For this reason, some reflections will be offered on the implications of present and futuristic practices involving Internet culture and cyborg studies. (shrink)

We illustrate, using a simple model, that in the usual formulation the time-component of the Klein–Gordon current is not generally positive definite even if one restricts allowed solutions to those with positive frequencies. Since in de Broglie's theory of particle trajectories the particle follows the current this leads to difficulties of interpretation, with the appearance of trajectories which are closed loops in space-time and velocities not limited from above. In a critical discussion, interlocutors can strategically maneuver by shading their expressed degree of standpoint commitment for rhetorical effect. When is such strategic shading reasonable, and when does it cross the line and risk fallacious derailment of the discussion? Analysis of President George W. Bush’s 2002–2003 prewar commentary on Iraq provides an occasion to explore this question and revisit Douglas Ehninger’s distinction between argumentation as coercive correction and argumentation as a person-risking enterprise. Points of overlap between Ehninger’s account and (...) pragma-dialectical argumentation theory suggest avenues for harmonization of rhetorical and dialectical perspectives on argumentation. Out of this conceptual convergence comes theoretical resources for understanding strategic maneuvering, by accounting for ways that discussants exploit gaps between their externalized and actual discussion attitude. As such higher-order strategic maneuvering played a major role in the 2003 Iraq prewar discourse failure, perspicacious understanding of this particular argumentative maneuver carries practical, as well as theoretical import. It is well known that we owe the term ‘aesthetics’ in its philosophical sense to the 18th century German philosopher Alexander Baumgarten. The eighteenth century's interest in aesthetics, however, pre-dated the invention of the term. In 1725, Francis Hutcheson published an Inquiry into the Original of Our Idea of Beauty and Virtue. This may be said to be the first sustained and significant work in philosophical aesthetics as we now know it. Hutcheson's volume preceded Baumgarten's by 10 years, and within (...) Scotland it inaugurated a series of philosophical writings on taste and beauty that continued for almost a century. Contributors included major philosophical figures like David Hume, Thomas Reid and Adam Smith, as well as influential figures less well known today such as Alexander Gerard, George Turnbull and Lord Kames. This article comprises a dialogue between two historians who have attempted, individually, to narrate the life of Lord George Gordon (1751 – 93), the Scottish prophet, revolutionary, and convert to Judaism. For modern cultural historians, Gordon's peregrinations between identities offer a kaleidoscopic view of Britain in the overlooked but crucial interstice between the upheavals of 1776 and 1789. Yet the partial nature of the evidence, the long omission of Gordon from the historiography of eighteenth-century Britain, and (...) the complex, often furtive nature of Gordon's activism create multiple ambiguities in his story. These ambiguities are compounded here by the authors' differing approaches. Marsha Keith Schuchard argues for a Gordon shaped by Scottish origins; Dominic Green, for a Gordon responding to English opportunities. They disagree over the likely date of Gordon's conversion to Judaism and, crucially, over whether he was a religious atavist or a Romantic pioneer. This dialogue is meant to illustrate the utility of a scholarship that acknowledges fuzziness rather than attempting to overclarify it. The article is also meant to show, however, that on the public stage fuzziness can be less benign: Gordon was a religious politician, who reworked his complexities and confusions into a violent, uncompromising critique of eighteenth-century British social order. Paper, kr. 375,–Though many associate Kierkegaard with isolated individuality, Kierkegaard scholars are rather gregarious. Four times since 1985, Kierkegaard devotees from all the inhabited continents have gathered at St. Olaf College for several (...) days of intense paper reading. Since it is difficult to keep a handle on so much material presented orally and because many were not able to attend, it is a commendable service that Houe and Marino have edited and published many of the papers delivered at the 2001 conference, just as they had previously published essays from 1998 conference and C. Stephen Evans and I had published essays from the 1989 conference.This volume reflects its origins in several ways. First, the essays are unusually brief compared to most journal articles (around ten pages each). While this is an agreeable format when listening to many papers in a single day, I do think that many of these essays are rather rushed and less than fully developed. Accordingly, the reader of these essays may well feel stimulated by interpretive suggestions rather than satisfied by thoroughly worked out treatments.Second, the essays are quite diverse, as conference papers tend to be, even when, as in this case, a preferred theme—hermeneutics and communication—was stated in advance. Since, as Alastair Hannay notes in the opening keynote essay, "hermeneutics" is used in a wide variety of ways, this theme really did not limit participants to any significant degree. Essays in this volume look variously at Kierkegaard's practice of hermeneutics (especially in reference to the Bible), at our predicament of interpreting Kierkegaard's notoriously elusive and cryptic pseudonymous works, at hermeneutics as our existential disposition as sense-making creature thrust into an ambiguous world, at hermeneutics as a quasi-Hegelian project of engulfing particularity without remainder in a totalizing whole, and, in contrast, at radical hermeneutics (a term coined by John Caputo and applied to Kierkegaard) as an interpretive approach that refuses the consolations and consonances of its Gadamerian cousin. As the use of "hermeneutics" varies, we hear that Kierkegaard is both an exemplary hermeneuticist and "the ultimate non-hermeneuticist." And in a number of essays, the issue of hermeneutics only seems to come up in the vacuous sense that the author offers a reading of some Kierkegaardian text or texts.The wide variety of essays included here reflects itself in the unsatisfactory final article in which Poul Houe makes a thoroughly desultory attempt at pulling the various articles together. I've tried my hand at writing such a piece, so I feel empathy for Houe's plight. But the paragraph per essay tour of the book is so hurried and so perfunctory that I wonder what purpose it really serves in this case.Though widely varying in topic and approach, most of the essays in the volume are quite good, if tantalizingly short. Given that there are twenty-five essays in the volume, it is not possible to summarize them here. But several observations are in order. First, it is especially nice to see five essays by Danish scholars included in this book. The community of Kierkegaard scholars has increasingly come to appreciate that viewing him in terms of his local context can be quite illuminating. American scholars have done excellent work along these lines, but clearly Danes have a crucial role to play in this interpretive task. Second, there have been heated disagreements in Kierkegaard circles over how to place Kierkegaard in reference to philosophical postmodernism. That polemic is in evidence in this volume as well. Several essays, most notably that of David Goicoechea, affiliate [End Page 502] Kierkegaard with postmodernist refusals of the totalizing understandings. In contrast, Sylvia Walsh juxtaposes Kierkegaard's "erotic hermeneutics," which treats its phenomenon with amorous tenderness, with Derrida's deconstructive approach to interpretation, which Walsh sees as a violent expression of the will to power. Christopher Simpson tries to reconcile these divisions by reading Kierkegaardian faith as an attractive... (shrink)

Frederick Douglass’s socio-political narrative is explored through an existential lens, arguing that Douglass is contesting the proposition that essence precedes existence. Douglass, through his fight with Covey, a white ‘slave breaker’, and his escape to freedom, affirms his existence (etymologically, ‘standing out’) as being for it-self ( pour-soi) over and against the reduction of his existence to that of being in-itself ( an-soi). Drawing from the work of Simone de Beauvoir, who was greatly influenced by the phenomenological and politico-praxic work (...) of Black novelist Richard Wright, it is argued that Douglass disrupts the power/knowledge regime of white American slavery, exercising his existential capacity for transcendence. Examining whiteness as a species of what Beauvoir calls ‘the serious man’, it is argued that whites within Douglass’s text are in a state of flight, performing their whiteness as ‘the serious man’, that is, where whiteness is accepted as an unconditioned state of being. Douglass’s narrative depicts whiteness as a flight from freedom (bad faith); for his very act of protestation against whiteness demonstrates that whiteness is not an objective, hypostatized thing, but a performative choice that sustains white hegemony. Reform of the federal income tax system has become a perennial item on the domestic policy agenda of the United States, although there is considerable uncertainty over specifics. Indeed the recent report of the President's Advisory Panel on Federal Tax Reform recommended not one but two divergent policy directions. In Fundamental Tax Reform, top experts in tax policy discuss a wide range of issues raised by the prospect of significant tax reform, identifying the most critical questions and considering whether the (...) answers are known, unknown--or unknowable. The debates over tax reform usually concern the advantages and disadvantages of income-based taxation as opposed to any of the several alternative forms of consumption-based taxation. The study of social values has its origins in the study of both cross cultural and within cultural differences in latent or manifest definitions of the right social order to achieve the good life. To this extent, the social scientific literature is replete with references to them. Yet, researchers either use the term values Social values are often used interchangeably with that of attitudes or treated as a post-hoc explanatory concept. When values are the focal research point, such endeavours predominantly (...) depart from universal and reductionist understandings of their functions, meanings and structures. Through tracing the roots of key theoretical and empirical investigations in values, originating in the work of Charles Morris, Gordon Allport, Florence Kluckhohn and Fred Strodtbeck, Milton Rokeach and Shalom Schwartz, we reveal the common as well as the different tenets underpinning their work. It will be shown that these accounts have lost sight of the importance of plurality and context. We claim that a renewed program of research in values is needed, which should be characterised by methodological pluralism in order to investigate a) value plurality, b) value specificity and c) values as properties and as processes. The task of this paper is to exhibit Wittgenstein’s method of perspicuous presentation as aiming at a distinctive kind of self-knowledge. Three influential readings of Wittgenstein’s concept of perspicuous presentation – Hacker’s, Baker’s and Sluga’s – are examined. All of them present what Wittgenstein calls the “unsurveyablity of our grammar” as a result of the “complexity” of our language. Contrary to this, a fundamental difference between matter-of-factual complexity and the unsurveyability of grammar is pointed out. What perspicuous presentations are designed (...) to deal with, isn’t, accordingly, occasioned by the complexity of our language but by an unnoticed assimilation of our own activities as speaking beings to matter-of-factual affairs. In response to this, perspicuous presentations help us to fully appropriate our activities as speakers in virtue of achieving a transparent understanding of the use of “our words”.
